Terms of Service
These Terms of Service govern your access to and use of FairFee, including our website, calculator, dashboard, portfolio features, and any related paid subscriptions. By accessing or using the Service, you agree to these Terms.

1. Eligibility and Accounts
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. You must provide accurate information and keep your account details up to date.
2. Service Description
FairFee provides tools for estimating freelancer payouts, comparing platform fees, approximating tax reserves, and tracking portfolio performance. Unless explicitly stated otherwise, all outputs are estimates based on user-provided information, publicly available fee structures at the time of implementation, and our internal calculation logic. FairFee does not provide financial, tax, accounting, investment, or legal advice. You remain solely responsible for your pricing, tax filings, business decisions, and compliance obligations.
3. Free and Paid Plans
FairFee may offer free and paid subscription tiers. The features available under each plan are described on the pricing section or checkout page in effect at the time of purchase. All prices displayed are exclusive of any applicable taxes. FairFee currently operates under the German small business exemption (§ 19 UStG) and does not charge VAT. If this status changes, existing subscription holders will be informed in advance. We may update plan structure, features, or pricing for future billing periods. Material changes affecting existing paid subscriptions will be communicated at least 30 days before they take effect.
4. Billing, Renewal, and Cancellation
If you purchase a paid plan, you authorize the payment processor shown at checkout to charge the applicable subscription fees, taxes, and any other amounts clearly disclosed during checkout. Subscriptions renew automatically for the selected billing period unless cancelled before the end of the current billing period. If you cancel, your paid features remain active until the end of the already paid term, unless mandatory consumer law requires otherwise. Free trial: Eligible new subscribers may receive a 7-day free trial of FairFee Pro. The trial begins at the time of checkout and converts automatically to a paid subscription at the end of the trial period unless cancelled before the trial ends. You will not be charged during the trial period. Each account is eligible for one free trial. To avoid being charged, cancel your subscription before the trial period expires via your account settings or the cancellation option described below. Where required by applicable law (§ 312k BGB), FairFee provides an online cancellation option for eligible consumer subscriptions.
5. Refunds
Unless mandatory law provides otherwise, first-time purchases may be refunded within 14 days of purchase if premium features have not been materially consumed or abused. Refund requests are reviewed in good faith on a case-by-case basis. This refund policy does not limit any mandatory statutory consumer rights, including any rights that cannot be waived under applicable law.
6. User Content and Saved Data
You may save calculations, client names, and portfolio-related inputs in the Service. You retain responsibility for the accuracy and legality of the data you enter. You must not upload unlawful, infringing, deceptive, or malicious content. We may remove data or suspend access if reasonably necessary to protect the Service, comply with law, or prevent abuse.
7. Acceptable Use
You agree not to: • use the Service for unlawful purposes; • attempt to reverse engineer, decompile, or extract source code except where such restriction is prohibited by law; • interfere with the security, integrity, or performance of the Service; • use bots, scrapers, or automated systems beyond reasonable personal use or any expressly permitted API usage; • impersonate another person or entity; • attempt to access data belonging to other users.
8. Intellectual Property
The Service, including its software, design, branding, logos, text, and calculation logic, is owned by FairFee or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of the Service or any intellectual property rights except the limited right to use the Service in accordance with these Terms.
9. Availability and Changes
We may modify, suspend, or discontinue parts of the Service at any time, including features, fee assumptions, integrations, or supported platforms. We do not guarantee uninterrupted availability, error-free operation, or compatibility with any third-party platform’s current fee policies.
10. Third-Party Services
The Service may rely on third-party providers such as authentication, hosting, analytics, and payment services. Your use of certain third-party services may also be subject to their terms and privacy policies.
11. Disclaimer
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy of estimates.
12. Limitation of Liability
To the fullest extent permitted by law, FairFee shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, lost business opportunities, or data loss. Our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the amount you paid to FairFee in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for intent, gross negligence, or injury to life, body, or health where mandatory law so provides.
13. Suspension and Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, misuse the Service, or create legal, security, or operational risk. You may stop using the Service at any time and may request deletion of your account in accordance with our Privacy Policy. Before deleting your account, you may request a copy of your personal data in accordance with your data portability rights as described in Section 11 of our Privacy Policy (Art. 20 GDPR).
14. Consumer Information
If you are a consumer, mandatory consumer protection laws of your country of residence may apply. Nothing in these Terms limits rights you cannot waive under such laws.
15. Governing Law
These Terms are governed by the laws of Germany, excluding conflict-of-law rules, unless mandatory consumer protection law requires otherwise. If you are a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction is Bremen, Germany, to the extent permitted by law.
16. Changes to These Terms
We may update these Terms from time to time. If changes materially affect your rights or obligations, we will provide notice by posting the updated Terms on the website and, where appropriate, by email or in-app notice before the changes take effect.

18. Referral Program
FairFee may offer a referral program through which existing users ("Referrers") can invite new users ("Referred Users") to create an account. • Reward: If a Referred User creates a new account using a valid referral link, both the Referrer and the Referred User may receive one (1) month of FairFee Pro access at no charge. Additional milestone rewards (e.g., for reaching 3 active referrals) may apply as described in the referral dashboard. • Eligibility: Rewards are granted only when the Referred User successfully completes account registration. Self-referral (referring your own account) is not permitted and will be disqualified. • Expiry: Referral-based Pro access expires automatically after the stated reward period. It does not renew and cannot be combined with a paid subscription to extend the reward period. • No Cash Value: Referral rewards have no monetary value and cannot be redeemed for cash, credits, or transferred to another person. • Fraud Prevention: FairFee reserves the right to disqualify referrals, revoke rewards, and suspend accounts if abuse, manipulation, or fraudulent activity is detected (including the use of fake accounts, bots, or automated sign-ups). • Program Changes: FairFee may modify, pause, or discontinue the referral program at any time. Changes do not affect rewards already credited to your account.
19. Right of Withdrawal (Consumers)
If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days of purchase without giving any reason. To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement (for example by email to hello@fairfee.app). If you withdraw from the contract within this period, we will refund the payment you made for the subscription. After the 14-day withdrawal period has expired, subscription payments are generally non-refundable unless required by applicable law. This does not affect any mandatory statutory consumer rights.
